TERMS OF SERVICE

These Terms of Service ("Terms") govern your access to and use of www.playwildchild.com (the "Site") and your purchase of products, gift cards, and consultations offered through the Site. By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, you may not use the Site or purchase from us.
Wild Child Custom Play LLC, doing business as Wild Child® ("Company," "we," "us," or "our"), reserves the right to update these Terms at any time. Changes will be effective upon posting to the Site. Your continued use of the Site constitutes acceptance of the updated Terms.
You must be at least 18 years old to make a purchase through the Site.
1. Scope of These Terms
These Terms apply only to products, gift cards, and consultations purchased directly through the Site.
E-design services and full-service, in-person design services are not sold through the Site and are governed by separate agreements, proposals, and invoices issued outside of the Site, including via QuickBooks or similar platforms. However, any products, gift cards, or consultations purchased through the Site by design clients are subject to these Terms.
2. Online Orders and Acceptance
By placing an order on the Site, you are making an offer to purchase the selected items. All products sold through the Site are custom-made.
We reserve the right to accept or reject any order in our sole discretion. An order is considered accepted only when you receive an order confirmation email from us.
Once an order is accepted, production begins. Due to the custom nature of our products, orders may not be canceled, modified, or refunded once production has begun.
3. Pricing and Payment
Prices are displayed on the Site and are subject to change without notice. You are responsible for the price in effect at the time of purchase, along with applicable taxes and shipping and handling charges.
Payment must be made using a valid credit card, debit card, or approved electronic payment method offered at checkout. By submitting payment, you represent that you are authorized to use the selected payment method.
4. Shipping and Delivery
Orders are shipped to the address you provide at checkout. You are responsible for ensuring that shipping information is accurate.
We use reasonable efforts to meet estimated shipping timelines, but we are not responsible for delays caused by carriers, manufacturers, weather, or other factors beyond our control. Some deliveries may require an adult to be present to accept delivery.
Risk of loss transfers to you upon delivery.
5. Returns, Damaged Items, and Refunds
All products sold through the Site are custom final sale and are not returnable.
If an item arrives damaged or defective, you must notify us within a reasonable time after delivery. At our discretion, we may replace the item or issue a refund. Refunds, if issued, will be credited to the original payment method.
If a manufacturer allows returns, any such return will be governed by the manufacturer’s return policy.
6. Gift Cards
Gift cards purchased through the Site:
Are non-refundable
Expire one year from the date of purchase
Have no cash value except where required by law
Will not be replaced if lost, stolen, or damaged
May only be redeemed with Wild Child
7. Consultations
Consultations purchased through the Site are final sale and non-refundable unless otherwise stated at the time of purchase. If the customer enters into a design services agreement with Wild Child Custom Play LLC, the consultation fee may be applied toward the design and project management fee, as set forth in the applicable design services agreement.
8. Privacy
Your use of the Site is subject to our Privacy Policy, which explains how we collect and use personal information. The Privacy Policy is incorporated into these Terms by reference.
9. Safety, Assumption of Risk, and User Responsibility
Products sold through the Site are intended for physical play activities that may include climbing, swinging, jumping, hanging, running, and similar movements. These activities are inherently hazardous and may result in serious injury or death, even when performed properly.
By purchasing and using our products, you acknowledge and agree that:
Adult supervision is required at all times
You are solely responsible for determining the age-appropriateness, individual readiness, physical ability, developmental stage, emotional maturity, and supervision needs of each child using the products
You are responsible for proper installation, inspection, maintenance, and use of all products unless otherwise agreed in writing
We do not provide medical, safety, or professional supervision advice
You assume all risks associated with the use of our products and agree that use is at your own risk.
10. Warranties and Disclaimers
We do not manufacture the products sold through the Site. Products are provided “as is” and without warranties of any kind, except as provided by the manufacturer. Any manufacturer warranties are solely between you and the manufacturer.
To the fullest extent permitted by law, we disclaim all express and implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of Liability
To the fullest extent permitted by law, our total liability for any claim arising out of or relating to these Terms or any purchase shall not exceed the amount you paid for the applicable product or service.
We shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of use, data, revenue, or goodwill.
12. Indemnification
You agree to indemnify, defend, and hold harmless Wild Child Custom Play LLC and its owners, managers, employees, contractors, and affiliates from any claims, damages, losses, liabilities, and expenses arising out of your breach of these Terms or your use of the products or Site.
13. Force Majeure
We are not responsible for delays or failures caused by events beyond our reasonable control, including acts of God, weather, labor disruptions, supply chain issues, governmental actions, or carrier delays.
14. Governing Law and Binding Arbitration
These Terms are governed by the laws of the State of North Carolina, without regard to conflict of law principles.
Any dispute arising out of or relating to these Terms or your purchase shall be resolved by mandatory binding arbitration on an individual basis only, and not through class or collective actions. Arbitration shall be administered by the American Arbitration Association and may be conducted remotely where permitted.
You waive any right to a jury trial or to participate in a class action.
You may elect to pursue an individual claim in small claims court if permitted by law.
15. Assignment
We may assign or transfer our rights under these Terms without restriction. You may not assign your rights without our prior written consent.
16. Severability
If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.

18. Entire Agreement
These Terms, together with our Privacy Policy and any applicable order confirmations, constitute the entire agreement between you and Wild Child Custom Play LLC regarding use of the Site and purchases made through it.
